Michigan Court of Appeals Affirms Lower Court Decision on Marshall Megasite

LANSING – In an announcement less than two weeks after hearing arguments from both sides, a three-judge Michigan Court of Appeals panel has affirmed the lower court decision as it relates to the Ford BlueOval Battery Park Michigan construction at the Marshall Megasite.

The decision was released on June 18, 2024, just one day prior to the preferred date Committee for Marshall-Not the Megasite wanted. Had the Committee been successful in its appeal, the timing could potentially have provided enough time for a Marshall referendum in November 2024.

In its decision, the court wrote:

“We affirm the trial court’s decision to dismiss the Committee’s claims. It correctly concluded that the Committee was not entitled to mandamus relief because of the existence of an alternative adequate remedy (namely, an appeal of the Marshall City Council’s final decision on certification) and the lack of a clear, legal right. It also correctly concluded that the ordinance at issue complied with the Marshall City charter.”
